These Terms of Use (“Terms”) govern your access to and use of the Pass Canadian Citizenship application and website (“the Service”), operated by Plus 44 Pty Ltd. By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Pass Canadian Citizenship is an educational study aid designed to help you prepare for the Canadian Citizenship Test. The Service includes 280+ practice questions, 16 mock exams, and a study guide, available in 13 languages. It is accessible via our website at passcanadiancitizenship.com, and through our iOS and Android apps.
Important disclaimers:
- The Service is not affiliated with the Canadian Government, Immigration, Refugees and Citizenship Canada (IRCC), or any government body.
- We do not guarantee that using the Service will result in passing the Canadian Citizenship Test. Results depend on your individual study and preparation.
- Content is for educational purposes only and does not constitute legal or immigration advice.
2. Eligibility
You must be at least 13 years old to create an account and use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate.
3. Account Terms
- You are responsible for maintaining the confidentiality and security of your account credentials.
- Accounts are personal and non-transferable. You must not share your login details or allow others to access your account.
- Your account may be used on up to 3 devices (for example, one phone, one tablet, and one computer).
- You must notify us immediately if you become aware of any unauthorized use of your account.
- We may suspend or terminate accounts that violate these Terms.
- You may request deletion of your account and associated data at any time by contacting [email protected].
- Accounts that have been inactive for 12 or more months may be deleted without notice. Progress and data associated with deleted accounts cannot be recovered.
4. Subscription & Payment Terms
Free Content
A limited number of practice questions and the study guide are available without a subscription.
Pricing & Auto-Renewal
A subscription to unlock unlimited practice is available for CAD $4.99 per week (or as displayed at the time of purchase). Subscriptions renew automatically each week until cancelled.
Platform-Specific Billing
- iOS: Billed through Apple via the App Store. Manage your subscription in Settings → Apple ID → Subscriptions. Subject to Apple's terms.
- Android: Billed through Google via the Play Store. Manage your subscription in Play Store → Subscriptions. Subject to Google Play's terms.
- Web: Billed through Stripe via our website. Manage your subscription in Dashboard → Profile. Subject to Stripe's terms.
Cancellation
You may cancel your subscription at any time through your platform's subscription management. Cancellation takes effect at the end of the current billing period — you will retain access until then.
Refunds
All sales are final. For iOS and Android purchases, refund requests are handled by Apple and Google respectively through their standard processes. For web purchases via Stripe, no refunds are provided for partially used billing periods.
Price Changes
We may change subscription pricing with reasonable notice. Existing subscribers will be notified before any price increase takes effect.
5. Intellectual Property
All content within the Service — including questions, explanations, study materials, and user interface design — is owned by Plus 44 Pty Ltd and protected by copyright and intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.
Content derived from publicly available Government of Canada resources (such as “Discover Canada: The Rights and Responsibilities of Citizenship”) is attributed accordingly and remains the property of the Government of Canada (Crown copyright).
6. Acceptable Use
The Service is for personal, non-commercial use only. You must not:
- Share, resell, or redistribute app content
- Use automated tools to scrape, data-mine, or extract content
- Reverse-engineer, decompile, or disassemble the app
- Share account credentials or allow others to use your account
- Use the Service for any unlawful purpose
- Attempt to circumvent subscription restrictions
- Purchase subscriptions through unofficial channels
7. Third-Party Services
We use the following third-party services to operate the Service:
- Supabase — account authentication and data storage
- RevenueCat — subscription management
- Stripe — web payment processing
- Apple App Store / Google Play — mobile payment processing
- Google Analytics (Firebase Analytics on mobile, GA4 on web) — anonymous usage analytics
- Google Ads — advertising (uses cookies; see our Privacy Policy)
Each service operates under its own terms and privacy policies. We are not responsible for any failure, interruption, or error caused by third-party payment processors or services.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. We collect your email address for authentication and anonymous analytics data to improve the Service. We do not sell your personal data.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties, express or implied, regarding the Service, including but not limited to:
- That the Service will be uninterrupted, error-free, or secure
- That content is 100% accurate, complete, or up to date
- That using the Service will result in passing the Canadian Citizenship Test
Nothing in these Terms excludes or limits consumer rights or guarantees under applicable Canadian consumer protection legislation, including provincial consumer protection statutes. Where our liability cannot be excluded, it is limited to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service is limited to the total amount you have paid us in the 12 months immediately preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or opportunities, even if we have been advised of the possibility of such damages.
This limitation does not exclude or limit any liability that cannot be excluded or limited under applicable Canadian consumer protection law.
11. Indemnification
You agree to indemnify and hold harmless Plus 44 Pty Ltd from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.
12. Termination
- We may suspend or terminate your access to the Service at any time if you violate these Terms.
- You may terminate your account at any time by requesting deletion.
- Upon termination, your right to use the Service ceases immediately. Cancellation of any active subscription is a separate action you must take through your platform.
- Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the app or by email. The “last updated” date at the top of this page will be revised accordingly. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You and we each submit to the non-exclusive jurisdiction of the courts of Ontario, Canada.
Before commencing any legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting us at [email protected].
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
